It is important to note that many court bonds require collateral. The underwriting is based on your good credit and Business Financial and/or Personal Financial statements.

 

If your company has your business financial statements on a computer program such as Quicken® or QuickBooks®, then by all means use those statements.

 

In some cases the surety underwriter may require copies of your most recent Federal Tax Return and/or Bank verifications. We will only ask for these items if and when the surety underwriter indicates that they are needed.

 

Surety will require a complete explanation of the facts of the case from the applicant or the applicant’s attorney.

 

Surety will need copies of any and all documents pertaining to the case.

 

Surety will need the name, address and phone number of all applicants and their attorneys. In cases involving mechanic’s liens, we will need copies of stop notices and any additional related paperwork.

 

In the case of bonds for trust, we will need a copy of the trust.

 

This is not a complete list of the items that surety may request. Most cases are straight forward as to the bond limits and terms. The majority of the work in getting the applicant qualified for the bond is in gathering all necessary information and making sure that all forms are accurate and complete.

 

Court Bond Checklist

  1. Court bond application must be completed and as accurate as possible. Please answer all the questions in full. Date and sign the application. Also, please make sure to complete the notorization (if needed).
  2. Current Personal Financial Statement and/or Business Financial Statement (if applicable).
  3. Court documents (any and all documents relating to the case).
  4. Complete explanation from the applicant and/or attorney of the case.
  5. Most recent federal tax returns; business (if there is a business involved) and personal. (Upon request of Surety Underwriter)
  6. Bank verifications (upon request of surety underwriter)
  7. If the bond involves stop notice or mechanic’s lien then surety will need you to provide the complete name, address and phone number of  the contractor or contractor's if more than one are involved.

Note:  Cash collateral may be required on some bonds. The amount and type of collateral will be determined by the surety company underwriting the bond.
